By using the Second Wheels website or services, you acknowledge that you have read, understood, and agree to these Terms and Conditions. If you do not agree, please refrain from using our platform.

2. Use of Services

Our services allow you to buy and sell pre-owned cars. You agree to:

• Provide accurate and complete information when buying or selling a vehicle.
• Use the platform solely for lawful purposes.
• Not misuse our services, including engaging in fraudulent activities or posting false listings.
• Maintain confidentiality of your account credentials.

3. Account Registration

To use certain features of our platform:

• You must create an account with accurate personal information.
• You are responsible for maintaining the confidentiality of your account information.
• You must notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate our terms.

4. Vehicle Listings

When listing a vehicle for sale:

• You must provide accurate information about the vehicle's condition, history, and features.
• You must own the vehicle or have authorization to sell it.
• You must include clear and accurate images of the vehicle.
• We reserve the right to remove listings that violate our policies or appear fraudulent.

5. Buying and Selling

When engaging in transactions:

• Buyers are responsible for verifying vehicle details before purchase.
• Sellers must provide truthful information about their vehicles, including condition and history.
• All transactions are final once payment is processed, subject to our return policy outlined in the Dashboard.
• Second Wheels facilitates transactions but is not responsible for disputes between buyers and sellers.

6. Engine Protection Plan

Our optional Engine Protection Plan includes:

• 12-month comprehensive engine coverage for ₹2,999.
• Coverage for all engine components and labor (labor costs are shared 50-50 with dealer).
• To claim, follow the process in your Dashboard.
• The warranty is subject to proper vehicle maintenance and excludes pre-existing conditions.

7. Payments

Regarding payments on our platform:

• All payments are processed securely through our authorized payment processors.
• Service fees may apply for listings and transactions as specified on the listing page.
• Engine Protection Plan costs ₹2,999 for 12 months of coverage with no hidden fees.
• Refunds are subject to our refund policy as outlined in the Dashboard.

8. Intellectual Property

Regarding intellectual property:

• All content on the Second Wheels platform is owned by or licensed to us.
• You may not reproduce, distribute, or create derivative works from our content without permission.
• By uploading content (including vehicle images), you grant us a non-exclusive license to use that content.

9. Privacy

Your privacy is important to us:

• We collect and process personal data as described in our Privacy Policy.
• By using our services, you consent to our collection and use of your data.
• We implement reasonable security measures to protect your personal information.

10. Limitation of Liability

Second Wheels is not liable for:

• Inaccuracies in vehicle listings provided by sellers.
• Mechanical or cosmetic issues with vehicles after purchase.
• Disputes between buyers and sellers.
• Indirect, consequential, special, or punitive damages arising from your use of our services.

11. Termination

Regarding termination of service:

• We reserve the right to terminate your access to our services if you violate these terms.
• You may close your account at any time via your Dashboard.
• Termination does not affect rights and obligations accrued before termination.

12. Changes to Terms

We may modify these Terms and Conditions at any time:

• Changes will be effective upon posting to the website.
• Your continued use of our services after changes indicates your acceptance of the new terms.
• We will notify you of significant changes via email or website notice.

13. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

14. Dispute Resolution

In case of disputes:

• We encourage users to first contact our customer support team.
• Any dispute not resolved through negotiation shall be submitted to binding arbitration.
• The arbitration shall take place in Gangarampur, Dakshin Dinajpur, West Bengal, India.
